That's trademark infringement. If the guitar manufacturer sued you, they'd be entitled to:
1) Profits generated from said item
2) Attorney fees
3) Statutory damages up to 100,000.

Wow, how much diference is there with a front headstock decal than a back custom shop one?, i did research too and its the same difference , i know its not the most legal thing but neither is any of you guys modds that use any Fender (R) decals, its the same thing, its just a decal,

i dont get it, i got some remarks when i first mentioned that i would be using the "JAzzmaster decal, but DAMN,!, what is this, did every one forget its just a decal like the the fender jazzmaster decal,

im not trying to sell it for any more than i usually would sell this type of neck for, im going by the amount of money i put into it, plus my labor time, and shipping, i really honestly, hardly make anything, you guys could ask a few of my previous clients, i actually made list and pictures of reciepts of all the supplies and parts i need to do this work, plus the value paid for the neck, and a little more than a week of non stop work, about 170 hours straight, to the point where i cant even straight my back or neck out from looking don for soo many hours,

like i said, im not selling it for any more than its worth, the labor and supplies, plus shipping, and thats pretty much it, one of my last jobs, that racing strip MIJ Jazzmaster i modded for someone, i B&B"D a mex strat neck, did some body work and worked my ass off and made 100 bucks, thats nothing for all that work and time , plus damage to my hands,

i cant even play right now from how fucked up my hands get and your not telling me this neck is worth about 300?,

thats crazy, and to bash a custom shop logo and talk about fraud when there are millions of people doing the same thing to their guitars with slapping on a front headstock decal using the "Fender" name, its the same thing,

go bash some one else, im just having some fun, i already had to change the decal and why not use a custom shop, is it not custom,

when i got restortion decals for a strat neck that needed a new decal because the owner that sent it to me tried to glue in smaller bushings into it and they kept falling out because of the old bigger holes already made, and i had to sand down the neck and restore the logo, so i ordered the one he wnted and i got a USA serial number that i havnet used yet but might on my neck, because Warmoth is made right here in the usa, so it would be more appropiate, so im holding on to that one for me

those cuts hurt like a bitch, if any salt or spices, even ketchup get into them , my hands are on fire, i rinse nd rinse in water and they still burn, i hardly can zipper my jacket and now wear rubber gloves when i eat. i cant risk getting anything into those cuts, its worse than when you cut you nails too short, and its not going away because im continueously doing this

I'm a noob, so what I say really doesn't matter, but here goes.

It doesn't matter if you made $1 profit, or $1000- it's still completely illegal. Will you go to jail? I doubt it. One guy in his house is hardly worth the resources and manpower it'll take.

However, if someone who buys your stuff decides to report you to Fender, and Fender decides to sue you, they'd have the law completely on their side.

The fact remains that what you are doing is blatant trademark infringement.

Oh, and the $100k I posted previously is per offense. So if you sold 5 Squier necks with Fender decals, and FMIC decided to sue, you could be liable for up to half a million dollars.

Also, even though I doubt you could be held legally responsible for what happens after the initial sale, the person who buys this off of you could pass it off as legit, which would fucking suck for whoever ends up buying it.

You can take that as a compliment, too.

I definitely think you do excellent work. Maybe it's time you consider taking full credit for it and make your own custom decals?

yes i changed the decal on this neck, a mex strat to a jazzmaster, and another strat that had glue dripping and dried on the front of the headstock on the logo, and had to sand and replace it with a new one, same style, those are the only ones i replaced and i have added two different ones to warmoth lic necks, and thats not even legit even though they are lic by fender and people do it anywy and so will i for my own, and if someone needs me to do it to thier necks, than i will because i do them really nice, but otherwise, i dont just randomly go around trying to sell fake necks and what ever was said up there, like i said, any decal changes i did were requested by other people or for my own guitar, i dont try to make a buck off it, thats not even what i consider work as far as the project goe, its fun doing decals instead of the carving and sanding, its light work compared to everything else, anyway, like i said , anyone that has done a decal before in my eyes has no right to say anything about my work, a decal is a decal, its even illegal to make my own name like someone mentioned and put it on a neck like this one, i cant claim this fender neck as my own, unless i completely made a neck from scratch , and than i could do that, but im not even close to making necks from bare wood, im not that good and look up to those on here and other sites that do make bodies and necks out of blank pieces of wood, i think thats amazing, the measurements and all, its way out of my league for now, but hope to get there some day

There's a world of difference between someone putting a logo onto a guitar they're keeping and a guitar they're building to sell. And you copped flak here as soon as you posited the idea of changing the decal from Squier - quite a few proud Squier users on this forum. Also, you need to realise that unless you've been requested to do the work, any custom work you to to a guitar (whatever that custom work is - a pickup swap, even) reduces the value of the guitar: your 'value of guitar + value of parts + never mind all the labour and injuries that go into it = value' equation is naive and misguided.

Also, you not having the courage of your convictions and editing out the above post where you discuss putting the legitimacy of putting a custom shop logo on a neck speaks volumes about you. Don't worry though, I kept a copy in case you post this neck on eBay.

Just to be clear, I moved this to the whorehouse because regardless of if you are selling these necks here or not, or how much money you are making from it, you are treating this as a business. You refer to the people who have purchased necks as customers, you've posted photos of thing you've bought with the proceeds, and you've mentioned buying to sell many times.

I think that's the same reason people have concerns over the use of the Fender Custom Shop logo when this is not a Fender Custom Shop product. If you're refinishing the neck, it's likely you will also refinish the headstock and that would require either a new decal or to leave the headstock blank. You're not wanting to claim the neck as entirely your own, and a Squier decal is difficult enough to come by, let alone a Squier Jazzmaster one. So a readily available Fender Jazzmaster logo, although not ideal (many would say to be proud of the Squier one and do what you can to keep it) is an acceptable compromise.

When you make these as a business and you apply a decal that cost any amount of money, the assumption you are making is that applying that decal will add more value to the product you are selling than the decal cost. So a set of Fender Custom Shop decals that cost $10 for two is needing to add more than $5 of value per decal for it to be worthwhile you adding it. That profiting from somebody else's name is what people here are uncomfortable with. To put a Fender Jazzmaster decal on the front brings about the reaction 'Well it's not really a Fender, but it's as close as you can get without being one, and a Squier decal isn't available so perhaps it's not that bad. I would rather see the Squier decal remain'. The Fender Custom Shop decal brings the reaction 'this guy is intending on conning somebody into believing this is something that it's not, and with that worth considerably more money than what it really is'.

Because you're running this as a business, and you have no involvement in the forum other than these threads, please keep all posts of this nature to this thread. There's no need to have many threads documenting the binding and blocking of many necks. Keep them all in one place.
