Yeah I think it's the artwork that is crossing the line, you are infringing trademark and product likeness which is a whole different bag to a circuit, which is not patentable.

I don't agree and will never agree with people who copy the logo and graphics on clones. I remember years ago before all the Z Vex hate somebody was selling fake Fuzz Factories on the net and passing them off as the real deal.
That sucks.

That's my take. When you copy the art you're infringing on trademark and also attempting to pass it off as an original (or it could be down the line). Not cool.
If I build someone a Fuzz Factory with my aesthetics I'm not actually breaking any patent or trademark law. If you copy the graphic art, name, and logo, you are.
